Conditions for dissolution of marriage (divorce) without the personal presence of both spouses:

  • consent of both spouses;

  • absence of common minor children;

  • absence of property claims;

  • issuance of a power of attorney to the representative to file an application and receive a Certificate of Divorce.

Details

The marriage is dissolved administratively and does not require obtaining a residence permit or Georgian citizenship. The marriage is dissolved in the territorial body of the Legal Entity of Public Law Agency for the Development of Public Services of the Ministry of Justice of Georgia. In cases where the spouses cannot be present in Georgia, the divorce is formalized by an authorized person on the basis of a relevant power of attorney.


The power of attorney must be made in notarial form (the registration and certification must be made by a licensed notary) and apostilled (certified with an apostille) or legalized in the country of issue.

After the divorce is formalized, each of the spouses will receive a copy of the Certificate of Divorce in Georgian, issued in his/her name.
